Terms of Use

1. About these terms

These terms are an agreement between you and [FULL NAME OR BUSINESS NAME], [POSTAL ADDRESS], Poland (“we”, “us”), for the Polish Exam Prep app and website (the “Service”). By creating an account or using the app you accept them. Our Privacy Policy explains how we handle your data.

If you use the Service as a consumer, nothing in these terms takes away the rights the law gives you.

2. Your account

• You must be at least 16 years old to use the Service.
• An account is for one person. Keep your sign-in details to yourself; you are responsible for what happens under your account.
• You can delete your account at any time in the app, under Profile → Delete Account. This erases your data permanently. It does not cancel an App Store subscription — see section 4.

3. Free plan and Pro

The free plan includes:

• 3 AI grades of your writing in total, which do not renew;
• 5 grammar drills a day, counted in your own time zone;
• up to 50 words in collections you create yourself;
• all built-in vocabulary, grammar topics and writing tasks.

Pro removes the daily drill and word limits and includes up to 50 AI grades a month. Each grade is a real call to an AI model that costs us money, so this is a fair-use allowance; it renews every 30 days from your first grade in a period.

A grade that fails for a reason on our side is returned to your allowance. If you are over a limit — for example, more than 50 words in your collections after Pro ends — you keep what you have and can keep studying it; you just cannot add more until you are back under the limit.

We may change what each plan includes. If a change reduces what you have already paid for, it applies only from your next billing period, and we will tell you in the app beforehand.

4. Subscriptions and payment

• Pro is an auto-renewing subscription, billed monthly or yearly through your Apple ID at the price shown in the app before you buy.
• It renews automatically at the same price unless you cancel at least 24 hours before the end of the current period. Cancel in Settings → your name → Subscriptions. After cancelling, Pro stays active until the end of the period you paid for.
• Apple processes the payment and is responsible for billing and refunds. Request refunds at reportaproblem.apple.com.
• If we change the price, Apple will notify you in advance, and where the law or Apple's rules require it, ask for your agreement before charging the new price.
• Right of withdrawal (EU): if you are a consumer in the EU, you may withdraw from a purchase within 14 days without giving a reason, by requesting a refund from Apple as above.
• A subscription is linked to the account that was signed in when you bought it, and can back only one account.

5. AI feedback

Writing feedback is generated by an AI model, which marks your text on the same criteria the exam uses. It is designed to help you practise, and:

• it is not an exam result and does not predict or guarantee your result in any exam;
• it can be wrong — about a score, a correction or an explanation — so treat it as guidance, not authority;
• Polish Exam Prep is an independent app. It is not connected to the organisers of the certificate exams.

6. Your content

The texts you write, and words and collections you create, remain yours. You allow us to store and process them to provide the Service — including sending your texts to our AI provider to be marked, as described in the Privacy Policy. We do not use your texts to train AI models, and we do not publish them.

Please don't submit anything unlawful, or anything you don't have the right to share, such as other people's personal details or someone else's work.

7. Using the Service fairly

You agree not to:

• use the AI feedback for anything other than your own learning — for example, to mark other people's work as a paid service, or to generate texts in bulk;
• get around the plans' limits, for example by creating accounts to collect free grades;
• interfere with the Service, try to access other users' data, or copy, scrape or resell its content;
• reverse-engineer the app, except where the law allows it.

If you seriously or repeatedly break these terms, we may suspend or close your account. Unless it would be unlawful or put others at risk, we will tell you first and give you a chance to respond.

8. Our content

The app, its vocabulary lists, exercises, writing tasks, explanations and design belong to us or our licensors. We give you a personal, non-transferable licence to use them through the app for your own learning.

9. Availability and changes

We work to keep the Service available, but it may occasionally be interrupted for maintenance or by problems outside our control. We may update, add or remove features. If we ever shut the Service down, we will give you at least 30 days' notice in the app.

10. Liability

We provide the Service with reasonable care and skill. Beyond that, and to the extent the law allows, we are not liable for indirect losses, or for decisions you make — including about when or whether to take an exam — based on the app's feedback. Our total liability to you is limited to the amount you paid for the Service in the 12 months before the claim.

Nothing in these terms limits liability that cannot be limited by law, including for harm caused intentionally or through gross negligence, or your rights as a consumer.

11. Changes to these terms

We may update these terms, for example when we change the Service or the law changes. We will update the date above, and for changes that matter to you, tell you in the app at least 14 days before they take effect. If you don't agree, you can cancel your subscription and delete your account before then.

12. Law and disputes

These terms are governed by Polish law. If you are a consumer living in another EU country, you also keep the protection of the mandatory consumer law of that country, and you can bring a claim in the courts where you live. Before going to court, please write to us — most problems can be solved by email.

13. If you downloaded the app from the App Store

These terms apply between you and us only, not Apple. In addition:

• Licence. Your licence to use the app is limited to Apple-branded devices that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions.
• Support. We, not Apple, are responsible for maintaining and supporting the app. Apple has no obligation to provide any support for it.
• Warranty. We, not Apple, are responsible for any product warranties, whether express or implied by law. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you, if any; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• Claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to the app or your possession or use of it, including product liability claims, claims that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar laws.
• Intellectual property. If a third party claims that the app or your possession and use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
• Legal compliance. You confirm that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-party terms. You must comply with any applicable third-party terms, such as your mobile data agreement, when using the app.
• Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, have the right to enforce them against you as a third-party beneficiary.
